SIGNATURE ONLINE LIMITED RESERVES THE RIGHT, AT ANY TIME, TO MODIFY THESE
CONDITIONS OF SALE.
1. Orders
By ticking the box that confirms you have read and agree to be bound
by our Conditions of Sale, you are making an offer to purchase the Product(s),
which you have specified in your shopping basket. All orders are subject
to acceptance by Signature Online Limited. Within 1 working day of our
receipt of your order, you will receive a confirmation of your order
by email, along with your order reference number. This number should
be retained for future reference. Any acceptance of your order by Signature
Online Limited is subject to these conditions of sale and to the availability
of stock.
Signature Online Limited reserves the right to withdraw any Products
from the SignatureBear Shop and may, in its sole discretion, refuse to
process an order for any reason at any time. In particular, Signature
Online Limited reserves the right to refuse to print personalised messages
which we believe, in our sole discretion, may bring Signature Online
Limited into disrepute or which are offensive or derogatory. We will
contact you if we consider that your message falls into this category.
Without prejudice to your statutory rights as a consumer, Signature Online
Limited will not be liable to you or a third party by reason of Signature
Online Limited withdrawing any Product or refusing to process any order.
2. Availability
Although Signature Online Limited endeavours to ensure that all Products
are in stock, occasionally, some Products may be temporarily out of stock
or sold out earlier than anticipated due to unexpected demand. Where
any Product ordered is out of stock, we will inform you of this by email
and will give you the option of continuing with your order (subject to
an extended delivery time) or cancelling your order. Where you choose
to cancel your order, any sum debited by Signature Online Limited from
your credit card will be re-credited to your account and Signature Online
Limited will notify you of this by email at the email address which you
provide in your order form. The refund will be made as soon as possible
and, in any event, within 30 days of the date of your cancellation of
your order.
3. Price and Payment
All Bear prices are quoted in £ sterling and are inclusive of UK
VAT at the current rates. There is a delivery charge of £3.50 regardless
of size of order for UK deliveries, and £49.00 for international
deliveries. VAT is charged at the current rates for UK and European Union
deliveries, but not for deliveries to the rest of the world. Except in
the case of manifest error, the prices payable for Products that you
order are as set out on the Website at the time at which you place your
order.
Payment may be made using a wide selection of credit and debit cards
(please refer to our Payment Method section in the Help Desk). You confirm
that the credit/debit card which is being used is yours. Your credit/debit
card details will be transmitted via the web to a secure server. All
credit/debit card holders are subject to validation checks and authorisation
by the card issuer. Signature Online Limited reserves the right to refuse
credit card payments in its reasonable discretion.
4. Description of Products
The Products depicted in the SignatureBear Shop are as seen. The reproduction
of colours and styles are as accurate as photographic and image processing
will allow. Signature Online Limited does not accept responsibility for
slight variances in colour and style.
5. Cancellation and Returns
No Quibbles Guarantee
Our ‘no quibbles’ guarantee means that if, for any reason,
you are unhappy with your purchase, i.e. the item you have ordered is
defective, or you have simply changed your mind then, provided that it
is in its original condition, you can return it to us for prompt replacement
or refund within 30 days of delivery. This guarantee applies only to
those items that have not been personalised with your choice of message
or text. Where you have ordered an item with your own choice of message
or text we can only offer a refund or replacement if the item that you
have ordered is defective. This is because it has been personalised for
you, which means that we would not be able to re-sell it.
Returns
If you want to return an item, simply click here
and complete the form
provided specifying your name and order number. By clicking on the ‘Submit’ button
you will be taken to pages that ask whether the goods were defective,
whether they had been personalised and whether you are seeking a refund
or replacement. We also ask you to give us a daytime contact telephone
number. If the item is returnable under our Returns Policy terms and
conditions, we will issue you with a returns address and a Returns Authorisation
Code. You must obtain a Returns Authorisation Code before sending anything
back to us or we will not otherwise be able to process your Return.
Defective Items
If you return an item because of an error on our part, or because it
is defective, we will happily refund your costs in returning it to
us. The item(s) must be returned in its original state within 30 days
of delivery.
Change of Mind
Products returned to us because you have changed your mind must be in
perfect re-saleable condition, and must be returned within 30 days
of delivery. Please note that item(s) returned to us for reasons not
due to our error or defective Product(s) will not have return postage/shipping
costs refunded.
Returned Item(s) Lost in Transit
We cannot be held responsible for packages lost in transit. As you are
responsible for returning the items to us, we recommend sending the
packages by Recorded/Special delivery.
Refunds and Replacements
For item(s) returned to us within 30 days of delivery with the appropriate
Returns Authorisation Code and in accordance with these terms and conditions,
a refund or replacement will be processed by SignatureBear within 14
working days of receipt of the returned items.
A refund will be made in the same form of payment that was used to make
the initial purchase. Replacements will be to your original specification
as detailed on your original order.
6. Delivery
Signature Online Limited will deliver the Products ordered by you to
the address you give for delivery when you make your order. You may
specify a delivery address, which is different from your invoice address,
if for example, you would like Signature Online Limited to deliver
the Products directly to a friend, a relative, or to your place of
work.
There is a delivery charge of £3.50 regardless of size of order
for UK deliveries and £49.00 for international deliveries. VAT
is charged at the current rates for UK and European Union deliveries,
but not for deliveries to the rest of the world. Delivery will be made
as soon as possible and usually within 7 days of our receipt of your
order, but please allow 28 days for delivery.
If you do not receive Products ordered by you within 28 days of the date
on which you ordered them, Signature Online Limited shall have no liability
to you unless you notify Signature Online Limited by email at info@signaturebear.co.uk of the problem within 40 days of the date on which you ordered the Products.
Unless you have cancelled your order prior to delivery, you will become
the owner of the Products once they have been delivered to you. In any
case, after delivery they will be held at your own risk and Signature
Online Limited will not be liable for any loss, damage or destruction
to the Products except insofar as it arises from an inherent defect in
any of the Products.
7. Liability
Unless otherwise agreed in writing, Signature Online Limited's maximum
liability to you arising by reason of or in connection with the supply
of the Products to you shall be limited to the amount paid by you in
respect of the Products in question ("Payment Amount"). Signature
Online Limited shall not in any event be liable to you for:
(i) any direct loss in excess of the payment amount; or
(ii) any loss of profits, business or anticipated savings or loss of
or corruption to data or any other indirect loss or consequential loss
whatsoever
even if it has been advised of the possibility of such loss.
Nothing in these conditions of sale shall exclude or limit the liability
of Signature Online Limited for death or personal injury due to its negligence
or for its fraud. This does not affect your statutory rights as a consumer.
8. Data Protection
Please see our Privacy Policy for details of the information which we
hold about you and the uses to which that information will be put.
9. Force Majeure
Signature Online Limited shall have no liability to you for any delay
or failure to deliver the Products to the extent that such delay or failure
to deliver arises from causes beyond the reasonable control of Signature
Online Limited including, but not limited to, fire, floods, acts of God,
acts or regulations of any governmental or supranational authority, war,
riot, strike, lock-out and industrial disputes.
10. Waiver
No waiver by us shall be construed as a waiver of any rights or remedies,
or any subsequent breach of any provision of these Conditions of Sale.
11. Entire Agreement
These Conditions of Sale, together with the Terms of Use, Returns Policy,
current Product prices, delivery details and contact details on this
Website, set out the whole of the agreement between you and Signature
Online Limited. Signature Online Limited's employees or agents are not
authorised to make any representations concerning the Products unless
confirmed in writing by Signature Online Limited. You confirm that you
do not rely on, and waive any claims for breach of any such representations,
which are not so confirmed.
12. Third Party Rights
A person who is not a party to the contract governed by these Conditions
of Sale has no rights under the Contracts (Rights of Third Parties) Act
1999 to enforce any provision of these Conditions of Sale.
13. Governing Law
These Terms and Conditions shall be exclusively governed by and construed
in accordance with the laws of England and you irrevocably submit to
the exclusive jurisdiction of the courts of England.
